Scarsdale man sues airline for $1M for trip from hell
A Scarsdale attorney is suing Delta Airlines for $1 million amid claims the airline ruined his holiday.
Attorney Richard Roth's tale of woe began at Westchester County Airport in Harrison on December 20. Roth and his family were slated to celebrate his mother's 80th birthday in Argentina, but say a delayed flight from Harrison caused them to miss a connecting flight in Atlanta.
The lawsuit claims Roth was informed he couldn't be guaranteed another flight to Argentina for two weeks due to the holiday travel rush. The family was finally able to book a flight and arrived three days late, but lost luggage in the process.
The attorney says rude treatment from the airline added insult to injury. According to Roth, smug gatekeepers kept him from boarding his plane despite empty seats and the door to the plane being visibly open. He also says calls to Delta after the trip for reimbursement went unanswered.
Roth is blaming Delta's negligence for $20,000 in expenses. Those expenses include new plane tickets, clothes and rental car bills.
"The airlines have to be accountable," he says. "There's a numbness. They don't care. They lie to you, they're obnoxious, they're rude."
Roth is considering expanding the case to a class-action lawsuit. Delta has no comment.
