The family of a Spring Valley man who was shot and killed during a confrontation with police says the Rockland County district attorney has promised to conduct and open, fair and independent investigation into the incident.
Police say Herve Gilles, a Haitian immigrant, was extremely violent during an altercation last week with a 20-year veteran officer before he was shot outside the El Buen Gusto bar.
Gilles' family says while the autopsy has been completed, it is still waiting for toxicology reports. It has been told the grand jury likely won't get the case until late January.
