Two state lawmakers are pointing a finger at the Department of Transportation after a 60-year-old man was hit and killed by an oncoming CSX train in Haverstraw Wednesday afternoon.
The incident occurred on Route 9W and New Main Street.
Jean Dure says his brother, Haitian immigrant Guy Dure, was mentally challenged and living at Greenhills Estate Home for Adults for the past two years. The family tells News 12 that Dure was on his way to the store in the village when he walked across the tracks and was hit.
In the wake of the fatal accident, local politicians are questioning the DOT.
"New Yorkers are at risk. We have seen accidents nearly double over the past couple of years,” says Sen. David Carlucci.
Sen. David Carlucci (D) and Assemblyman Thomas Abinanti (D) say the DOT is overdue with its report on the safety of the state's more than 5,300 railroad crossings.
He is demanding a look into crossings, including the one in Haverstraw, before another tragedy happens.
News 12 reached out to the group home, Greenhills Estate.  In a statement, it said, "Residents are allowed to come and go whenever they please. According to the Health Department we are not allowed to lock the doors or tell residents they can't go out."
Greenhills Estate also told News 12 that it holds monthly safety sessions for residents on how to travel safely and walk across the tracks.
