Man convicted of killing Yonkers college student free...for now
A man who served six years for killing a Yonkers college student has been released from prison after his conviction was overturned. Anthony Disimone was convicted of stabbing 21-year-old Louis Balancio to death outside a Yonkers bar in 1994. Former District Attorney Jeanine Pirro was in charge of the case at the time. Her office failed to turn over 300 documents to defense attorneys in time, nullifying the conviction. Two weeks ago, Disimone?s attorneys fought to keep him out of prison for good, but a panel of judges said the suspect must be tried again. Westchester District Attorney Janet DiFiore will oversee the new trial, though the new charges are still unclear. DiFiore said an investigation is pending and refused to comment further. Disimone's lawyers say their client didn?t commit the murder and claim Nick Djonovic could be the real killer. They say some of the 300 documents in question contained a confession by Djonovic that he stabbed the victim.
