Ulster County officials say a man accused of dismembering his girlfriend has been indicted for murder.
The suspect, 50-year-old Damon Foy, is facing a slew of charges, including murder, assault, human concealment of a corpse and criminal contempt.
“{It was} a total disregard for human life,” Sheriff Juan Figueroa says. “Absolutely horrible.”
Authorities say parts of 44-year-old Alberta Dale’s body were found dismembered Apr. 3 inside Foy’s apartment at the Hudson Valley Commons on Granite Road after family had not heard from the victim and called police for a welfare check.
Other remains were found in the Town of Marlborough, according to the Ulster County Sheriff’s Office.
Dale was from Scranton, Pennsylvania but often spent time with Foy in Kerhonkson, according to neighbors who say Foy was frequently heard and seen assaulting the victim before her death.
Authorities say Foy was facing domestic violence charges for assaulting and strangling Dale in January and was out on $5,000 bail when he killed her.
News 12 talked to one of Foy’s neighbors who didn’t want to be identified. She says she witnessed Foy attack Dale previously and called police when he was arrested for allegedly hurting last winter.
“I’ve called the police. Everybody around here has called police about him. So, I don’t even know how it got this far,” said the woman.
Dale had a restraining order against Foy before her death.
He was indicted last week.
“Today is about the first step toward getting justice for Alberta and being her voice to shed light on the way in which she was brutally taken from our community and those who loved her,” says Ulster County Chief Assistant District Attorney Elizabeth Culmone-Mills.
Authorities say Foy tried to tase police with their own taser when he was being taken in for questioning and was punched by an officer during the incident. He was taken to the hospital and later charged.
A GoFundMe for Dale has raised more than $5,000 for her funeral.
Foy is being held in Ulster County Jail without bail.
