Defense attorneys in the murder trial of the disbarred Chappaqua lawyer accused of killing his wife played a 911 tape for the jurors Thursday.
On the 12 and a half minute recording, the panic-stricken voice of Carlos Perez Olivo can be heard telling a 911 operator that he and his wife had been shot by a gunman who cut them off on Route 100 in Millwood.
Perez Olivo?s attorneys claim the shooter got into the back of his car. A struggle ensued, resulting in the death of the lawyer?s wife, Peggy Perez Olivo.
Prosecutors argue that Perez Olivo, who previously had an extramarital affair, was the one who killed his wife to get access to $900,000 in life insurance policies.
During closing arguments, the defendant?s attorneys called the prosecution's case one of speculation and innuendos, adding that the jury has been presented with a fairy tale.
Perez Olivo faces 25 years to life if convicted of second-degree murder.
