A retrial is already scheduled for January in the case accusing a Brooklyn man of sexually assaulting and killing a jogger in Queens two years ago.

According to the Queens District Attorney, a mistrial was declared Tuesday in the trial of Chanel Lewis.  

He is accused of killing 30-year-old Karina Vetrano in August of 2016 as she went jogging in the park near her Howard Beach home.

The decision from the judge came down after only a day and a half of jury deliberations.  The District Attorney tells News 12 that Lewis will be back in court in January.

The Legal Aid Society, who is representing Lewis in court released a statement saying in part, “this case is far from conclusive and the jury's deadlock proves this. The death of Karina Vetrano is tragic and our hearts go out to her family, but the rush to criminalize our client is not the answer nor is it justice."
