Pace Law School legal scholar Bennett Gershman says there's no question that Brett Kavanaugh is headed to the Supreme Court to fill the seat that belonged to Justice Anthony Kennedy.
Gershman, who is a progressive in his politics, believes Kavanaugh's appointment will likely mean a hard shift for the highest court in the land.
“It’s going to be moved in as far as a right conservative ideologue stance than it’s been in more than a generation, maybe even 100 years,” he says.
Gershman says from hot-button issues, like immigration and affirmative action to gun rights and government regulations, Kavanaugh has amassed a long track record of right-leaning rulings on the federal Court of Appeals. He says he believes that once on the Supreme Court, Kavanaugh could weigh in on more controversial matters that could change settled laws.
On the issues of executive powers, he believes the president shouldn't be interfered with. Kavanaugh appears to be following past precedent during his confirmation hearing, talking a lot but saying little.
Gershman says he fears what Kavanaugh will do once on the bench.
