Ex-Spring Valley inspection chief planning lawsuit after fire charges were dismissed

Spring Valley’s former chief building inspector is planning a lawsuit.
Wayne Ballard was charged with falsifying inspection reports involving the Evergreen Assisted Living Facility — but a judge dismissed the case after the prosecution rested.
In March 2021, 79-year-old Oliver Hueston and 35-year-old volunteer firefighter Jared Lloyd died during a fire at the facility on Lafayette Street.
Ballard has now begun the process to sue Rockland District Attorney Thomas Walsh and several prosecutors.
In his claim, Ballard seeks to recover monetary damages, among other things, over claims of false arrest, malicious prosecution and violation of civil rights.
Ballard said he was prosecuted because of a prolifically inspired acceptance of a baseless accusation.
News 12 reached out to the district attorney’s office but has not heard back.
