With just a few weeks remaining in the race for county legislator in the 16th District, the GOP is trying to get the opposition thrown off the ballot based on a technicality.

Republican Cicely Greaves-Vega appeared before a judge Friday in an effort to get Democrat Ken Jenkins removed from the race. Greaves-Vega's attorney claims the Democrats jumped the gun when they named Jenkins as a candidate. The attorney says the Democrats needed to wait until the board of legislators met on January 8 to set the date for the special election before they named a candidate. However, Jenkins disagrees and calls the move an attempt to try and steal another election. He claims a vacancy occurred January 1 when Andrea Stewart-Cousins became a state senator.

Another issue in the race is whether or not the candidates actually live in the district they are trying to represent.

The special election for the 16th Legislative District will take place February 13.
