Stony Point residents are demanding justice after the motorist in an alleged fatal hit-and-run was released without bond.
The incident occurred on Christmas Eve on Route 9W in Stony Point by Filors Lane.
News 12 is told Maria Rose Osai, 35, was crossing the street when she was struck and killed by a driver who then fled. She was taken to Westchester Medical Center where she succumbed to her injuries.
The man allegedly behind the wheel was identified as 27-year-old Jorge Flores-Villalba. He is charged with leaving the scene of a fatal accident.
Flores-Villalba has since been released without bail under New York state’s new bail reform law that eliminates bail for misdemeanors and most non-violent felonies.
Those who knew and loved Osai say she was a hard worker and had a huge heart. They’re also wondering why the alleged driver was released without bail.
"It was hard to wake up Christmas morning and not have her with us and know that he got to spend Christmas with his family. It just doesn't seem fair," says neighbor Irene Secone.
Controversy surrounds the new law, with many feeling it’s immoral.
“If a person who does not have roots here in the community and flees the scene, flees the country or worse has no license… what's to stop this individual from getting behind the wheel of a vehicle and driving and causing another accident?” questions Stony Point Supervisor Jim Monaghan.
A GoFundMe page has been created for those wishing to assist with funeral arrangements for the mother of three.
Flores-Villalba is due back in court on Jan. 9. Osai’s family plans to attend and stand up for her to ensure she gets justice.
