A wrongful death lawsuit against the Newburgh Police Department is now moving to trial.
A judge in White Plains has ruled that a reasonable juror could conclude the officers' use of force was a "substantial cause" of 25-year-old Nathaniel Cobbs' death in 2007.
Cobbs died after police responded to a report from his ex-girlfriend that he was high on PCP and violent inside her home. Newburgh police say officers used a dog and a stun gun to subdue him.
Court documents say Cobbs was banging his head and was unresponsive by the time he arrived at the station. He died hours later.
The judge dismissed claims against two officers who weren't directly involved.
