News 12 is learning more about the consequences for an illegal daycare in New City.

Clarkstown officials say the owners must pay a $40,000 fine before the May deadline.

The owners will also never be allowed to run a child care facility in the town.

The day care on Maple Avenue was shut down last July, just a few days after its opening.

The town supervisor says the fine is said to be one of the largest penalties issued in town history:

"There's zero tolerance. We're about to add our seventh code enforcement officer. When I started as supervisor we had one part time code enforcement officer. We're adding code enforcement officers unfortunately because we have to and we're going to enforce our code. That's the message people should take."

The owners also face child endangerment charges in Clarkstown town court.

However, the Rockland district attorney's office is asking the judge to recuse himself due to the defense council’s role in hosting a campaign fundraiser for him.
