Appeals court temporarily releases Gateway Tunnel Project funding

Funding dried up last Friday, months after President Donald Trump said he was terminating the project.

A federal appeals court has allowed a temporary restraining order to take effect, requiring the Trump administration to release some funding for the Gateway Tunnel Project.

Funding dried up last Friday, months after President Donald Trump said he was terminating the project.

U.S. District Judge Jeannette A. Vargas granted a temporary restraining order and then granted a brief stay of her order to allow for a decision from the 2nd Circuit Court of Appeals.

That appeals court declined to overrule the lower court’s decision, meaning the restraining order is now in effect and the federal government must release the funding.

"The president must end this reckless fight and keep legally obligated funds flowing to ensure the nation's most urgent infrastructure project is never stopped again. If they don't, we'll continue to see them in court, and continue to win,” Gov. Mikie Sherrill wrote in a statement.

“The Trump administration can no longer continue its unlawful policy of freezing funding for the Gateway project. The Trump administration's funding freeze policy is plainly unlawful,” wrote acting Attorney General Jennifer Davenport.

When the funding ended on Friday, about 1,000 construction workers were laid off from the project.
