T-Mobile is now on the hook for having cell towers in Mount Vernon after losing another court battle with the city.
Mount Vernon launched a lawsuit six years ago against T-Mobile over the right to tax them for six cell towers in the city.
The state Court of Appeals upheld a lower court decision and ruled that cell towers and transmission equipment, such as antennas, cables and so-called stealth walls that hide the equipment, are subject to being taxed by municipalities.
The ruling allows the city to continue to collect at least $43,000 a year for city taxpayers and more than $100,000 for the school district.
News 12 reached out to T-Mobile for a comment about the ruling, but has not heard back.
Lawyers for the company argued against the tax, insisting they already pay to lease space on the top of buildings.
The victory by Mount Vernon could have far reaching implications for all the other mobile companies who have telecommunications equipment across the entire state.
