MIDDLETOWN -

An Orange County man who was fighting to stay with his family has been deported.

News 12 has learned that 62-year-old Toribio Cervantes was sent to Mexico Wednesday.

There was an ICE raid at a factory where Cervantes worked back in 1993. Rep. Sean Patrick Maloney says even though the father of five could not read English and didn't have an attorney present, he was forced to sign a voluntary departure document.

Cervantes never left and was arrested at his home in Middletown in July, two months after being pulled over for a broken tail light.
