Woman pleads not guilty to DWI in Mamaroneck restaurant crash

The 79-year-old Yonkers woman accused of driving drunk into a popular Mamaroneck restaurant was arraigned in Mamaroneck Village Court Thursday.

Roseanne Cassano did not speak during her arraignment, but her attorney entered a not guilty plea for the DWI charges against her.

"Our position is that this was simply a terrible accident," says Cassano's attorney Jeffrey Chartier.

According to published reports, Cassano told police she had two drinks at Enzo's Ristorante on Mamaroneck Avenue Sunday night. After she left the restaurant around 8 p.m., surveillance video shows Cassano pulling her red Kia out of a parking spot in front of the popular restaurant, slamming into a white car, then accelerating in reverse. Cassano, who had a passenger in her car, ended up crashing backward through the glass doors of Enzo's. The popular spot was full with customers and staff. Nine people were injured, four of them critically.

According to police reports, Cassano failed field sobriety tests and refused to take a Breathalyzer test.

Cassano's attorney maintains his client was not intoxicated when she left Enzo's Ristorante Sunday night.

"Consuming alcohol and having a drink at dinner is not intoxication," he said.

According to police, all the victims are expected to make full recoveries. Cassano's attorney released a statement for her to the victims: "She is very grateful and thankful that they are recovering. Her heart goes out to them, to their families."

Cassano's license has been suspended and she remains out on $200 bail. She is due back in court next month.

People who were at Enzo's restaurant at the time of the incident tell News 12 that Cassano was served one drink Sunday night and she did not finish it.
