DMX hopes music will keep himself out of jail

Yonkers native DMX wants to use music to get out of jail.

The rapper, whose real name is Earl Simmons, plans to play some of his music for the judge overseeing his sentencing for tax evasion.

DMX says he is likely to be too upset to speak directly to the judge Thursday in Manhattan. So he says he wants to play his music because it will allow the judge to "understand him genuinely in his voice."

Prosecutors call DMX's crime brazen and seek a five-year prison sentence.
