A Port Chester woman is suing a Westchester doctor who she claims was distracted by his cellphone while performing surgery on her.

Mary Edwards, 70, claims in a lawsuit filed Monday that Dr. Eric Fishman, of WestMed Medical Group, was on the phone while she was under local anesthesia and undergoing surgery for varicose veins.

The attorney for Edwards claims she was cognizant of what was happening around her, even listening to the conversation, some of it in Spanish.

Edwards claims Dr. Fishman apologized, explaining he was taking a Spanish proficiency exam so he can care for Spanish-speaking patients, but Edwards said through her attorney that she was petrified.

"This is about a doctor who intentionally or recklessly caused our client severe emotional distress, terrorized her psychologically, because instead of postponing her surgery or postponing the language proficiency test, he thought, he could do both," says Katie Wendle, Edwards’ attorney.

News 12 reached out to WestMed Medical Group, but it did not comment due to pending litigation.
