Convicted killer to remain free on appeal in Sparrowbush

A Sparrowbush man can remain free on bail while he appeals his conviction for killing an alleged rapist.



David Carlson, 45, was convicted in November for killing alleged rapist and wanted fugitive Noris Acosta Sanchez. Last week, Carlson was sentenced to five years behind bars, but a day later, was released by the same judge after the defense filed an appeal.



In Orange County court in Goshen today, the judge ruled to keep the father of three children free on $500,000 bail during his appeal.



Carlson's lawyers say they are basing their appeal that the jury was confused by legal instructions and requested for a mistrial.



Prosecutors argued that Carlson's appeal will eventually be denied and asked for him to be kept behind bars.
