Mistrial declared in case against the Ossining School District

A mistrial was declared in the case that pitted a former student against his alma mater.

Rahssan Simmons and his mom filed a lawsuit against the Ossining School District in 2000, claiming the school failed to protect Rahssan from being sexually molested by a school secretary.

The trial was in its fourth day, but when Simmons' lawyer called a surprise witness, the district's lawyer told the judge she did not know about the witness. Linda Cronin, attorney for the Ossining School District, said in the three years since the lawsuit was filed, she had never heard about the witness called by the Simmons' lawyer in connection with the case.

Simmons' lawyer said the witness had just come forward now because he had only just learned about the trial.

Simmons, who is a former Ossining High School basketball star, says he had an affair with former secretary Felicita DeJesus beginning in 1998 when he was just 15. He also contended that his prospects for an NBA career were damaged by the affair.

A new trial is expected to take place sometime next year.
