The 24-year-old officer brutally beaten at a White Castle in the Bronx and then shot by friendly fire has died.
On Tuesday, scans performed at St. Barnabas Hospital on Officer Eric Hernandez of White Plains showed no brain activity. Hernandez's family had said they were preparing for the worst.
Police say six men attacked Hernandez at a White Castle in the Bronx on January 28. Following the attack, Hernandez made his way to the parking lot where he drew his weapon and pointed it at a man he thought was one of his attackers. Police asked Hernandez to drop his weapon and when he didn't comply, he was shot three times by Officer Alfredo Toro, of Washingtonville. The six suspects in the attack have all been formally charged with gang assault.
