Police investigate fatal accident on NYS Thruway in Cornwall

Police are investigating an accident on the New York State Thruway in Cornwall that left one person dead and another injured.

Investigators say Luckner Augustine stopped to help Herman Miller, of Long Island, repair a broken down box truck he was driving at mile maker 54 when a UPS truck driven by Louis Nunciata swerved to try and avoid hitting Augustine's car but still struck it, which in turn hit both Augustine and Miller.

Augustine was killed by the impact, and Miller suffered a broken leg.

Police say that video eveidence indicates that Augustine's car was actually parked in the right lane of traffic, and because of possible fog the vehicle may have been obscured from Nunciata's view.

Police say at this time no charges have been filed against Nunciata.
