Family files lawsuit against NYPD, officers
A Bronx family has filed a lawsuit in Bronx Supreme Court against the NYPD and the two officers who they say assaulted 14-year-old Javier Payne back in May.
The two officers being sued are Sgt. Eliezer Pabone and Officer Joffre Cortez
Payne's mother says her son still has visible scars from being thrown through the glass pane window at The Hookah Spot.
On Thursday afternoon, Javier, his mother and attorney Scott Rynecki met on Arthur Avenue where the incident occurred.
"The violent act of pushing a man through a glass window is uncalled for and this type of behavior should not be condoned by the city of New York or the police department," he said. The family is calling on NYPD Commissioner Bill Bratton to institute departmental charges on the officers for using excessive force on Payne.
Last week, the district attorney said he could not move forward with charges against NYPD Officer Eliezer Pabone because there were bullet holes in the window that compromised its stability.
