MOUNT VERNON - A Mount Vernon man appeared in court Wednesday to faces charges that he shot and killed a 13-year-old budding basketball star on New Year's Eve.

David Hardy, 21, appeared in Mount Vernon city court to face second–degree murder charges in the death Shamoya McKenzie. Hardy's family hired a new attorney, who took over the case Wednesday.

Federal and local law enforcement officials say Hardy fired shots at 28-year-old Prince Scott on Dec. 31 in an apparent gang fight. A stray bullet hit McKenzie as she sat in the passenger side of her mother's car.

Investigators describe both Hardy and Scott, the intended target, as gang members with long criminal histories.

Hardy was on parole at the time of the shooting and remains in custody while the case heads to a grand jury.

A memorial basketball tournament in McKenzie’s honor is scheduled for Friday at Mount Vernon High School. Organizers say all of the proceeds from the basketball tournament will be given to the McKenzie family.
