CARMEL - A mistrial has been declared on the two most serious charges in a rape case against a Mahopac restaurateur.

The jury remained deadlocked on charges of third-degree rape and criminal sexual conduct against Mahopac restaurant owner Lani Zaimi. He was found not guilty on a misdemeanor charge of unlawfully dealing with a child.

Zaimi, who owns Ariano's Trattoria, was accused of raping an 18-year-old waitress at the restaurant after he allegedly plied her with alcohol. Zaimi claims everything that happened was consensual.

The prosecution will decide if they're going to proceed with a new trial.
